I am sure you employer must not have told you that and didnt apply that way. Typical of consulting firms, so taht they can get you to pay another labor..which they can use for substitution.

Hi, This is my first post here and I need some guidance regarding new-H1 under FY2010 quota.
--One of my friend told me about this company in Chicago who is doing H-1s and apparently the quota is not over yet. I am in India and
--Is it advisable to get my H01 filed at this time?
--What if the USCIS asks client letters? They said, the company will take care of it if that happens -- is that even legal to say that?
--What is the probably the CAP will be met by that time they file my H-1 in the next 2 weeks? And am not sure if the attorney returns the money in that case.

You cannot know about a revoked I-140.
But if you filed a 485 based on that 140, then since 140 denial/revoking automatically closes the 485, you will get a denial notice for the 485 and that is how you know.

You can go visit India after your AP has been applied for, and you can ask your lawyer ( if you are using one ) to send the docs to you in India , so that you can come back with the new approved AP, off course you can't enter USA on an expired AP.
My lawyer has confirmed that one is only required to be present in the USA when applying and it's recommended that one is in US when it's approved, but due to the varying time USCIS is taking to process AP applications that is not a requirement and they can forward the documents to someone not in US.
You can go out of Country after applying for an AP, using an old unexpired AP, but you must return before the old AP expires??? This is what I read somewhere. You may not be able to use the New AP which is approved after you leave the country.
I read it somewhere! Just take openion of a good lawyer, before taking such an action.

If EB2 PD is 1 APR 2004 then what does the ProcessingTimeFrame Date(August 25, 2006) mean for I-485 in Texas Service Center.

What that means is "All applications received before August 25, 2006 AND whose PD is current , are being processed"
If your PD is 2003 but you filed your I-485 after Aug'2006 your app will not be adjudicated.
If you filed before Aug'2006 but your PD is after Apr'2004, your app will not be adjudicated.
If your PD is before Apr'2004 and you filed your app before August 25, 2006, your app will be adjudicated..
This is to make sure people don't start expecting approvals and calling them left and right one day after filing if their PD is current. they need some time for every application, so they put in this 'processing date' which works in conjunction with 'priority date' to check if a case is approvable at any given time. These are all good suggestions and translate well from my film days. I also read that, whereas in b&w the adage was expose for the shadows and develop (or print) for highlights, in digital it is the reverse - expose to preserve detail in the highlights and then use your curves in RAW to fix the shadows where you want them. So I'll have to put all that to work this week / weekend. If the flowers stay around, that is.
Yeah, that seems like a reasonable approach. The b&w film is probably much more tolerant to overexposure than the sensor, same as colour film, you can overexpose several stops, and as long as you compensate in the printing phase. Not so with digital cameras, they can tolerate only a very mild case of overexposure. In RAW it's a little bit more tolerant than if you use JPG in the camera, but only because the most fine details in the highlight is lost when converting from internal RAW pixels to 8-bit pixels for the JPG. Also consider that the lost information is actually just the last few bits, so when multiplied up to show a decent image, you'd still get a pretty sketchy result.
I'd also like to concur with Josh about the sensitivity: the range that the sensor can accept intense light is pretty much the same for all DSLR's for the same generation. You'll just have to live with it, compensate for it and wait for the next generation of sensors that are more tolerant... ;-)

From the text I can derive two conclusion either it is directed to undocumented worker or everyone is put in same basket nothing specific about our cause. Apu dont get me wrong I apprerciate your initiative but it should not happen we sign to support Kennedy he comes out as hero for Latino community (did I forget to mention political gain) and we remain where we are and watch those illegals immigrant become US citizen.

Infact I think the letter from his campaign representative is a way to get to the heart of our cause. We will sign once there is assurance in writing that it includes H1s.
I am sorry but with all due respect to Sen Kennedy he could address the rally of bunch of illegals waiving Mexican Flag and demanding their "RIGHTS" in Spanish. We have sent faxes in English to Senetor Kennedy requesting to support Bill that will provide relief to Legal immigrant communites but still nothing specific to our cause.
All the support we got till now are mostly from Republicans so we should abstain from supporting that is anti-republican.. More over we do not want to get caught in the crossfire between Dems and Repb.
FOLKS ONE MORE THING BEFORE WE SIGN "ANY" PETITION WE CONSULT OTHER MEMBER OF THE GROUP.

You guys are the experts.. I am a newbie. Good I asked, I would have never known!!
Am I missing something here. Isn't it via country of birth and not country of citizenship. There might be better ways to get around the system. EB2 Indians should marry EB3 ROW folk and apply cross-chargeability! I have yet to think of a way out for EB3 India!
