    Guys,

    There is no point in fighting over the inconsistency of CIS in picking applications. All of us know that a lot of people got approved last year during visa gate and many were left over even though their PD's are current. No one knows how USCIS picks an application for adjudication. It is clearly neither completely RD based nor PD based. It's up to the whims and fancies of CIS.
    If IV were to make agenda's on the inconsistencies of USCIS, the list will be endless.

    I have 04 PD and am waiting. I have friends with 06 PD's who got approved. I know its frustrating to watch your friends get approved and to have your own case pending for no reason. But this is NOT some thing we should be surprised about. CIS is trying to maximize visa number usage and trying to approve as many applications as they can. All of July 07 filers have passed the 180 days since the FBI name check has been initiated and ideally CIS should be approving applications with old PD's. We all know that we don't live in an ideal world. Imagine all these visa numbers going wasted. I personally (NOT IV) will try to get an answer to this FIFO issue, but the situation itself is short lived and probably will not exist by Oct 1st 08.

    So, how are u going to help us????

    Two weeks back, your priority was to file a law suite against porting from EB3 to EB2.

    Now after seeing your own buddies get approval before you, you put the previous plan on hold (sure you have not dropped it) and working on the new item.

    All we can do is to send letters to USCIS to expedite the process and give SunnySurya green card at the earliest.

    So not only EB3 but EB2 also escape from new issues.

    I am with you.

    You are almost there, you will get GC tomorrow or next week, who knows.

    Senators and congressman in MN are not very helpful I guess, first they told me wait one month and if I dont hear anything then they will send a request, after one month I called them up to find out whether they can help, that guy in senator office told me to wait 6 more months.

    It's not like my case is lost or in transit or not assigned to an officer, it is assigned to an officer on june 29th, officer at infopass said may be the officer who has my file have more old cases compare to others.

    Hmmm, and congressman or senator?
    Keep pursuing, you may find help from some direction.

    Can some body point me to the full text of the bill if it is available. Also throw some light on sec 302.
    Does this relate to only H1-B premium processing or to all petetions including the adjustment of status?

    I'm no senior member, but I would guess your red dot to be a feature of the software running this forum. Depending on the number of posts (50,100 etc), it changes.

    The red/green dot is based on the response from other members to a members post. (see the balance icon on the header?) If a member's post is continously rated as I disapprove, the green dot changes to a red one.

    This thread has lost direction and purpose. From a question of what will happen once lame duck session starts, it has degenerated into an "us vs them" argument which has no end. Ultimately, this thread is being closed.

    Hi,

    I landed in July 06 in Toronto. Received my PR cards etc and then moved back to US and since then have not visited Canada.

    Does anybody know how long one can stay out of Canada after landing? I heard some where its 2 years and some say its 3 years from the date you land.

    Can somebody please clairfy that? or have any official ruling on that?

    Thanks for clarifying. At first glance, the points you propose seem eminently reasonable and cannot be disputed. However, the real issue here is not what we "should" but what we "can".

    Re contacting NumbersUSA and FAIRUS, do go ahead but I'm certain there is no chance of them holding hands with us and singing 'Kumbaya'. The discussions and postings on those sites look like they have been written up by "Ed Anger" of the World World News :D

    And re toning down immigration bills to our advantage, you have to recognize that the primary issue is not that a bill will be passed which will not be optimal - the issue is whether any bill will be passed at all.

    Very simple.

    1. We should focus our resources and lobbying efforts to tone down immigration bills on our behalf. Spending our money to go there and put one more soul to say to Sen. Specter "vote for this bill" does not cut it.

    2. We should use our lobbying resources and connections to contact decision makers from NumberUSA, FAIRUS.org and other major organizations and communicate our plans. We should clearly adopt a position against any bill which supports amnesty and offer a sensible, reasonable and fair quantitative increase in Employment Visa numbers. An example of reasonable proposals would be temporary increase of visa numbers, elimination of visa lottery and reallocation of visa numbes to EB, visa number recapture.

    With this issue of priority date taking a back seat to notice date when dates are current :

    While it is frustrating to the people with older priority dates (including me); it could very well be that USCIS is approving people with later priority dates sooner because its simply easier for them to do so. I really hope that this trend does not last beyond Aug-Sep. And in October, for EB2 - I, there is still a good likelihood that for people with priority dates < 2004, dates may still be current. So they can very well be approved from Oct onwards. So if I have to sacrifice a few months of waiting time to make sure visa numbers dont go wasted. I am prepared to do so.

    Also it is very likely that people with older priority dates have a longer history in the US. So USCIS might need more time correlating all entry/exit time stamps, making sure we were in status all this while; but a person with 2006 priority date might have entered the US in 2005 & so less history to check.

    Also there is the case where later priority dates were using PERM. since PERM was made to be less abusive than the previous LC process, maybe they take less time cross checking LC data.

    It is unfair. So is life. Do I think a person with EB3 with priority date 2002 needs to wait 5 more years than a person with EB2 priority date 2006. No thats unfair as well.

    Complaining issues such as this to the authorities will only make one thing clear - The current US immigration is full of such vagaries. It needs a clear & complete over haul. Thats not gonna happen soon.

    For now, I think we just be satisfied with our EAD cards & AP & wait for the GC when it comes. It will be little less frustrating if we dont keep looking at immigration trackers.

    Rolling back dates is so unprofessional :mad: - means those idiots have no idea of how much demand there really is or will be :rolleyes:. This is not a stock price that has to go up or down based on current demand.
    Rather than immigration reform. They should clean up USCIS & DOS. get more efficient people in there. Now that the economy is so bad they should be able to get a lot of good people.

    Either case, I don't think those Behan Cs at USCIS are going to change the dates for EB3 until they are done going thru all the pending cases. Plus, unless there is searing pain all around there is no need for legislation. So dates rollback maybe a positive sign - a build up for CIR. But who am I kidding?

    No. Usually agreements define maximum time period or a condition (whatever happens first).

    Here is one example. An actor may agree that he won't sign any other role until this movie is completed or 12 months from the agreement date.

    That observation on the SKULL bill and masters degrees was raised by few concious and noble members of this forum before.

    Do you realize that in certain schools I know very well here, they don't even require you to take TOEFL or GRE/GMAT for grad school. Believe me, there are thousands of people in the world with $20K who would line up for such "graduate" schools and move here permanently. I am saying, any lobbying effort should be directed to tone down such bills, they are simply not very realistic at this point.

    If skill bill is passed in the same form as it is Americans will be alarmed seeing the inflow based on exemption of US based Master degree and STEM. Not only to Americans it is threat for current H1s and green card holders as well. The problem is those who have money in India can get admission in USA MS degree in any non standard college(I do not think INS can evaluate whether it is standard or not). So atleast 4 times of current MS students will come and they will get h1(I think Ms people has exemption in quota) thro Desi consultants by paying Money and get green card immeditely. This will defeat the purpose of skill bill itself. And also India so many people are doing MSC they can get gc easily here(As we know Indians or anyone will use loopholes to come here and get gc). If immigration is increased so much then it will impact all kinds of exsisting people. I think there should be control in number of h1s and also green cards. I am clear that both H1 and green card numbers should be increased but blanket exemption should not be given any category especially for H1. There were a situation on 2000 and 2001 lot of people returned India because of too much supply and Americans were angry with immigrants at that time especially H1 because they were laid off.

    So basically increase of immigration should be based on supply and demand . The purpose of Labour certification is to verify whether any american is rejected for that job. But that is now just formal and real test is not done(it is not possible to do it. If they do it it will take years to clear). I think if they double number of gcs the retrogession issue will be resolved for atleast another 5 years

    I dont understand why are people trying to correct and change each others thinking & views. This is a public forum and people have the right to post their views. I had another gentleman try and correct me last week . I think it was some guy named "eb3India".
    The kind of language people use is embarrasing. We are all professionals and there are some etiquettes we ought to stick with. Kindly refrain from using sarcastic language against each other.

    If you dont like something ignore it . If you cant ignore it, kindly use proper language to ask the person why he thinks in a certain way. If you dont get an answer that person is not worth talking to.And dont be worried about others getting disheartened. We are all grown-ups & professionals.
